Three men arrested in 2008 in connection with multiple Road Town burglaries appeared in Magistrates’ Court Tuesday, where their cases were scheduled to be sent to the High Court via a paper committal, but the indictable charges against them were dropped by the Crown after acting Principal Crown Counsel Tiffany Scatliffe said her office was unable to obtain copies of police interviews that allegedly incriminated the men.

Doyle Guishard was charged with two counts of burglary, one count of theft and one count of handling stolen goods, according to court records. Tyrone Thomas was charged with eight counts of burglary, one count of theft and two counts of destroying property. Felix Warner was charged with three counts of burglary, one count of theft and two counts of destroying property.

At the time of their arrest, a police press release said the three were allegedly linked to at least four commercial burglaries “in the Road Town area.” Information from the public and from United States Virgin Islands authorities helped a team from the Criminal Investigation Unit find the men, according to the release.

But on Tuesday, Ms. Scatliffe said that despite writing several times to police, her office was unable to obtain copies of interviews conducted with the defendants.

“As a result of the failure of the police to properly deliver these interviews, these cautioned interviews, the Crown is of the belief it would be unfair and unconscionable to proceed,” she told Magistrate Tamia Richards, in withdrawing the charges.
