Berenice Freeman, an agriculture officer who was employed by government for more than 20 years, was unlawfully retired from her position, a High Court judge ruled last month.

Ms. Freeman, who was retired on April 14, 2008, is entitled to a loss of 12 months’ salary — $45,840 — along with other damages, Justice Kelvin John ordered on May 2.

She is to be paid through the Human Resources Department, according to court records.

Those records said Ms. Freeman claimed wrongful dismissal because she wasn’t granted a fair hearing in the proceedings leading up to her forced retirement. She also alleged that she was never given a chance to cross-examine her accuser, the records added.

After reviewing evidence from both sides, Mr. John found that the recommendation by the PSC to retire Ms. Freeman in the public interest was unlawful.
