Justice Nicola Byer sentenced David Turnbull and Kurt Rabsatt to four and five years in prison, respectively, at the High Court on Friday, defence attorney Valerie Stephens-Gordon confirmed.

In June, a nine-member jury found the duo guilty of robbing Carl Dion Wheatley outside an East End strip club in November 2014.

During the trial, Senior Crown Counsel Leslie-Ann Faulkner alleged that the two defendants grabbed Mr.Wheatley as he was leaving the club, hit him with an object, and stole $300 to $400.

Mr. Wheatley recognised the attackers from his school days, and reported the matter to police, the prosecutor said.

However, defence attorneys Michael Maduro and Ms. Stephens-Gordon argued that the Crown had a weak case against their clients, as the only evidence was the testimony of Mr. Wheatley, who they said frequently appeared unreliable.

Mr. Wheatley provided conflicting information about the amount of money that was stolen, the date and time the crime occurred, and how much alcohol he had consumed that evening, according to Ms. Stephens-Gordon.

Ms. Faulkner acknowledged that the virtual complainant claimed he was robbed on Nov. 8, 2014, whereas a police report states that the crime took place the following day, but she insisted that the discrepancy was a minor detail.

“The date has nothing to do with the element of the offence,” she remarked.
