Scrub Island

A three-judge panel dismissed an appeal from Chiverton Construction Limited that alleged the developers of Scrub Island Resort had caused it millions of dollars in damages relating to a construction dispute. Mainsail, Scrub Island’s Florida-based developer, hired CCL to build five retaining walls in 2006. But after the company delayed in building three of the walls, Mainsail fired the company in December 2006, according to a recently published judgment from the Eastern Caribbean Supreme Court of Appeal. Mainsail alleged the company did not “supply enough properly skilled workforce on the project to successfully complete the works,” the judgment stated. In 2007, CCL and its managing director, Junior Chiverton, sued the developer for breach of contract but lost the suit, when Edward Bannister, a judge in the ECSC’s Commercial Division, ruled against them in 2009. Mr. Chiverton appealed the decision, alleging that the judge had erred at trial because he didn’t consider as part of the contract two letters the developer had sent CCL. The letters directed CCL not to begin construction on the three retaining walls, worth an estimated $182,148, according to the court judgment.

Cayman Islands

The Cayman Islands economy grew by 1.3 percent in the first six months of this year, compared to a contraction of 4.1 percent over the same period in 2010, the territory’s government reported. Cayman’s economy is expected to grow by 0.9 percent in 2011 and is being driven by strong performance in the hotel and restaurant sector, according to a government press release.
