Yates Construction Co. Ltd. filed suit against Oil Nut Bay Development Ltd. last Thursday, claiming the resort developer failed to pay for nearly $500,000 in construction work for which an invoice was sent in June.

The construction firm is seeking $479,151.82 “in respect of work carried out pursuant” to a June 2009 agreement between the two companies “and particularised in the June 2011 invoice” submitted to Oil Nut Bay, according to court records.

Yates Construction is also seeking $100,000 for “additional works carried out at the request and with the consent of [Oil Nut Bay] done but not yet billed by [Yates Construction], or, alternatively, damages for breach of contract,” according to a claim form filed in the lawsuit.

Jennifer Merriman, an officer of Victor International Corp., Oil Nut Bay’s parent company, took issue with the claims in an interview Tuesday.

“We fully disagree with their claims,” she said. “Our position is that Yates Associates has been paid 100 percent of what it’s owed.”
