A judge ruled Monday against a marketing firm that had sued the BVI Tourist Board for $1.2 million, awarding no further damages stemming from its breach of contract claim.

The Zimmerman Agency, which until 2009 had public relations and marketing contracts with the BVITB, was awarded a $225,000 judgment by commercial court judge Edward Bannister last year. But the judge said a second part of the judgment, which addressed a payment of $75,000 per month from May 31, 2009 until the date that Mr. Zimmerman “accepted the board’s repudiation” of the contract, would have to be determined. Earlier this month, that part of the judgment was set aside and Monday Mr. Bannister ruled that Mr. Zimmerman accepted the board’s repudiation of the contract on April 19, 2009.

Mr. Zimmerman said Monday that the judge’s decision to penalise it for not charging the BVITB after May was unfair and that the company will consider appealing the decision.

BVITB Chairman Neil Blyden, who was appointed to the post in December 2010, said he was pleased with Mr. Bannister’s decision.
