A High Court judge quashed a regulator’s finding Tuesday that the mobile phone provider Digicel engaged in anti-competitive behaviour against its smaller competitor. The action cancels a fine levied against the company by the Telecommunications Regulatory Commission, which on June 1, 2012 announced that it would fine both Digicel and LIME for allegedly engaging in a “margin squeeze” against their rival CCT Global Communications.

 

Both larger companies objected to the regulator’s decision and filed separate requests for judicial review.

High Court Justice Nicola Byer made her ruling on Digicel’s application Tuesday, siding with the company over the TRC. LIME’s application remains before the courts.
