Charges of assault and damaging property were dropped against three men after they spent roughly a year awaiting a decision from Magistrate Charmaine Rosan-Bunbury, who has been interdicted from duty since May.

“Due to the circumstances, Your Worship, due to no fault of either side, we were unable to get this decision,” Senior Crown Counsel Christilyn Benjamin told Magistrate Tamia Richards in court Tuesday.

Ms. Benjamin added, “We have no idea when we will get a decision.”

Analdo Tyson, Tristan Mills and Mitch Christopher were arrested after allegedly attacking a man and a woman outside a Road Town restaurant at about 4:30 a.m. on June 15, 2008. At the time, prosecutors said the two victims received “serious bodily injuries resulting from the alleged attack.”

They were also accused of destroying property, including earrings, a gold chain and part of the woman’s clothing.

Two counts of assault occasioning actual bodily harm and one count of damaging property were dropped against each of the three defendants.

“The prosecution is asking that I dismiss the matter against you, because of our own internal issues that have been occurring in the judiciary,” Ms. Richards told the defendants.
