Magistrate Charmaine Rosan-Bunbury has been interdicted from duty since May 4, but it’s in the public interest to share her story now, she told reporters last Thursday during a briefing in the offices of Rosan Law.

Ms. Rosan-Bunbury said she was removed from duty “by the governor on advice from the Judicial and Legal Services Commission” on May 4. The magistrate said the reasons given to her for removal were “misconduct” and “insubordination” to Senior Magistrate Valerie Stephens, Deputy Governor Inez Archibald and David Archer, the permanent secretary in the Deputy Governor’s Office.

Ms. Rosan-Bunbury called these allegations “baseless.” She said an application for judicial review of the decision to interdict her was filed June 20.

Ms. Rosan-Bunbury said an application was filed July 29 for an injunction to halt any further actions by the governor and the Judicial and Legal Services Commission until after the judicial review decision. Justice Rita Joseph-Olivetti denied that application.

The Court of Appeal is expected to hear a challenge to that decision Wednesday.

Ms. Joseph-Olivetti yesterday adjourned a hearing on Ms. Rosan-Bunbury’s application to a date to be determined, giving lawyers time to file additional affidavits.
